Developer posting agreement
This Developer Posting Agreement ("Agreement") governs how real estate developers ("Developer," "you," "your") upload, publish, and manage project content on the CondoGrid platform.
By submitting any project, file, media, or information to CondoGrid, you agree to be bound by this Agreement, in addition to the CondoGrid Terms & Conditions and Privacy Policy.
1. Purpose of this agreement
CondoGrid is a platform that displays pre-construction and new development projects to brokers, agents, and prospective buyers. Developers upload their own materials, and CondoGrid displays them "as provided."
This Agreement ensures that:
- You legally own the content you upload
- You give CondoGrid the rights we need to display it
- You are responsible for accuracy and compliance
- CondoGrid is protected from liability arising from developer content
2. Developer responsibilities
You agree to:
2.1 Provide accurate project information, including:
- Pricing
- Floor plans
- Renderings
- Amenities
- Availability
- Delivery timelines
- Deposit structure
- Project descriptions
- Sales team assignments
2.2 Maintain updated project information
You must promptly update CondoGrid if:
- Pricing changes
- Availability changes
- Timelines shift
- Floor plans are revised
- Incentives or commissions change
- A project is sold out or canceled
CondoGrid is not responsible for inaccurate or outdated information.
2.3 Provide lawful, rights-owned content
You represent that all media uploaded is either:
- Owned by you
- Licensed to you
- Approved for public use
This includes renderings, photographs, floor plans, video materials, documents, branding assets, and architectural content.
3. License granted to CondoGrid
By uploading content, you grant CondoGrid a worldwide, non-exclusive, royalty-free license to:
- Host and store the content
- Display it on project pages
- Distribute it to brokers and users
- Use it within the platform interface
- Use it for marketing, demos, case studies, or promotional content
- Include it in search results and marketplace displays
- Resize, compress, process, or optimize files for platform performance
This license is required to operate the platform.
3.1 Marketing license
You grant CondoGrid permission to publicly promote your project using your uploaded content, including:
- Social media posts
- Demo videos
- Broker marketing campaigns
- Feature highlights
- Platform demonstrations
If you prefer to limit marketing use, you may request restrictions in writing.
4. Prohibited content
Developers may not upload:
- Copyright-infringing materials
- Unlicensed renderings from architects or designers
- Misleading pricing or false availability
- Content that violates fair housing laws
- Content containing confidential or private information
- Nudity or inappropriate imagery
- Malware or harmful files
Violation may result in removal or suspension.
5. Accuracy & compliance
5.1 Developer takes full responsibility
You acknowledge and agree:
- CondoGrid does not verify your content
- CondoGrid does not guarantee pricing or availability
- CondoGrid is not responsible for errors, omissions, or outdated data
- You assume full legal liability for your published materials
5.2 Compliance with laws
You must ensure your content complies with:
- Fair housing regulations
- Real estate advertising rules
- Architectural copyright laws
- Trademark obligations
- Digital content usage rights
- Local, state, and federal regulations
You indemnify CondoGrid for any violations arising from your content.
6. Lead routing & inquiry handling
If you enable lead routing:
- CondoGrid will forward inquiries to your designated contacts
- You are fully responsible for answering leads
- CondoGrid is not liable for lost, delayed, or mishandled leads
CondoGrid does not participate in real estate representation.
7. Data & analytics
Developers may receive analytics such as:
- Views
- Impressions
- Engagement
- Downloads
- Geographic interest
- Broker activity
- Benchmark comparisons
These analytics are informational only and are not guaranteed to be accurate, complete, or error-free.
You may not misuse analytics to:
- Scrape broker data
- Identify brokers for unsolicited outreach without consent
- Reverse-engineer competitor performance
8. Removal, editing & termination
CondoGrid reserves the right to:
- Remove content violating these terms
- Disable access to non-compliant listings
- Request edits or corrections
- Suspend or terminate developer accounts
Developers may request project removal, but CondoGrid may retain archived copies for:
- Legal and audit purposes
- Performance analytics
- System backups
9. Fees
If the developer participates in a paid plan, subscription terms apply as per the SaaS Subscription Agreement.
Fees are non-refundable.
10. Liability
To the fullest extent permitted by law:
- CondoGrid is not liable for developer misrepresentation
- CondoGrid is not liable for inaccurate content
- CondoGrid does not guarantee sales, leads, or results
- CondoGrid does not verify uploaded materials
- Developer assumes all risks related to real estate transactions
Your sole remedy for disputes is termination of use.
11. Indemnification
You agree to defend and indemnify CondoGrid from claims arising from:
- Misleading or false project information
- Copyright or trademark infringement
- Licensing violations
- Misrepresentation to brokers or buyers
- Regulatory violations
- Any business losses tied to developer content
This applies even after termination.
12. Governing law & arbitration
This Agreement is governed by the laws of Florida.
All disputes will be resolved through binding arbitration in Miami-Dade County, Florida.
No class actions. No jury trials.
13. Entire agreement
This Agreement, combined with the CondoGrid Terms & Conditions, forms the complete agreement for developers posting content to the platform.
