Florida rules

Buying pre-construction in Florida: common questions

Deposits, the 15-day cancellation right and closing, with the sections of the Florida Statutes behind them.

General information, not legal advice. Have a Florida real estate attorney review any contract before you sign it.

Deposits are paid in stages, often 10% at contract and more at groundbreaking and top-off, for a total of 20% to 50% of the price before closing. Under section 718.202 of the Florida Statutes, the first 10% must be held in escrow. Money above 10% can be used for construction only if the contract allows it and says so in bold type on its first page. Each listing shows its deposit schedule when the developer publishes one.
